Kofoed German Shepherds

Breeding animals is not an exact science. While the genetics and inheritance is know for some traits in the dog, others remain highly variable. The bottom line is, the two best dogs in the world, can still produce lack luster, or even problematic offspring.

To protect the buyer from such uncertainty, Kofoed offers a very good written quality guarantee for each of the puppies placed into a new home. The guarantee is as follows, and is subject to change:

Hereinafter called "Buyer," is desirous of purchasing the animal described above; now therefore, in consideration of the following:

Deposit: $150.00 US (non refundable, may be applied to a different puppy at a later date)
Purchase Price: $XXX.XX (Shipping cost and crate are additional)

Use of the Dog:
It is agreed between seller and buyer that this dog is being acquired as a family companion dog or as a working dog to be used for tasks appropriate to its breed such as herding, search and rescue, therapy dog, obedience, or agility competition. Certain stipulations for conformation exhibition/breeding are stated else where in this contract.

The buyer swears that they are not purchasing the animal for resale and swears that he or she is not acting as an agent in the purchase of this animal and that it will remain solely in his or her custody. Buyer further swears that he/she is not associated with a pet shop or animal broker, and that this animal will not be used or trained for activities which are illegal. or for which it is not suited by reason of temperament or conformation. Specifically it will not be used to hunt or fight other animals.

Health and Structure:
The seller warrants the animal to be in good health and free from parasites as of the time of sale. The seller strongly encourages the buyer to have the animal seen by a Veterinarian of buyers choice within 48 hours of picking up the animal. Said animal may be returned to the seller for any reason within the 72 hours following purchase. Provided that the animal has not been damaged in any way, the buyer will then be entitled to a refund of the original purchase price less the non-refundable deposit. Expenses associated with the return of the animal will be the responsibility of Buyer.

The seller guarantees all animals sold against genetic or congenital health defects as listed following until the age of 12 months:

Chronic Degenerative Radiculomyelopathy (CDRM)
Cleft Palate
Disqualifying dental faults according to the AKC breed standard
Epilepsy
Haemophilia
Pituitary Dwarfism
Von Willibrands Disease (VWD)
Hip Displaysia (OFA Certification worse than Fair)
Elbow Displaysia

Where Hip Displaysia and UAP, FCP, and UCP are concerned, the warranty extends to 18 months. Diseases 6, 7 must be diagnosed by two qualified veterinarians, one of whom will be selected by the breeder. In a case of diseases 1, 8 and 9, diagnosis must be made by the Orthopedic Foundation for Animals (OFA) and a copy of OFA evaluation and associated radiograph must be sent to the seller before any action is taken. The buyer may return the animal, at no expense to the seller, in return for a puppy from the next available litter or the buyer may keep the animal and receive a replacement at a later date. It is understood by the buyer that under no circumstances will the purchase price be returned. This guarantee is void if a bitch conceives a litter or a male sires a litter. No replacement will be provided if the animal is disposed of without the Seller's consent.

Unless otherwise stated under the Terms or Other Conditions section of this contract, Seller also guarantees that the animal will conform to the current AKC German Shepherd Dog Breed Standard to the effect that it will have no disqualifying features of its conformation until the age of 18 months.

Ownership:
The buyer agrees that ownership and/or possession of this animal will not be transferred without written consent of the seller. The buyer will not abandon the animal to a shelter or give the animal away. The seller will accept the return of this animal at any time the buyer declines to keep said animal; however, the seller is not obligated to refund any of the purchase price except within the first 72 hours after purchase. If the animal is found to have been sold or given away without seller's consent and seller discovers this, the seller will take legal action and original buyer of the animal will be responsible for all legal expenses incurred.

The buyer agrees to maintain the animal in a humane environment and properly train and care for it. Specifically the animal will be properly licensed and inoculated against rabies, distemper, parvovirus, and other communicable diseases as recommended by a qualified veterinarian. The animal will not be allowed to roam and will be socialized and obedience trained appropriately.

The Buyer agrees to keep in contact with the Seller and inform the Seller of results of shows, test, or evaluations performed by or on this animal. The Buyer also agrees that in the event of any health or behavior concerns that arise during the ownership of this animal, the Buyer will use all reasonable measures to resolve the issue and keep the Seller updated with the development of the problem or success. The Seller agrees to be of any assistance possible.

Registration:
The seller certifies that the animal is eligible for registration under the regulations of the American Kennel Club as a purebred German Shepherd Dog and will provide proper forms for such a registration. In an effort to ensure that only animals that will provide an improvement to the breed are used for breeding, all animals are sold with a Limited AKC Registration application (offspring not registerable). The individual litter registration papers will be given to the buyer after seller receives proof of sterilization to the said above dog. The AKC Limited Registration can be lifted by the seller and will only be lifted if the following conditions are met:

1. AKC title achieved, Schutzhund achievement or demonstrating work toward earning a title
2. OFA certified hips (prelim number also accepted)
3. Temperament tested or Canine Good Citizen tested and proof of a certificate
4. A veterinarian health certificate is provided as proof of good health
5. Animal does not show any disqualifying faults as found in the AKC German Shepherd Breed Standard

The buyer will be responsible for the fee charged by the AKC to lift the Limited Registration. If the buyer has no interest to pursue the above conditions, the animal should be spayed or neutered.

Terms or other conditions:

This writing constitutes the full agreement of both parties. Wherefore, the above named Seller and Buyer have executed the foregoing contract of sale at ___________(am/pm) on this _____ Day of ______________, 2001 in Vancouver, WA. U.S.A.
